  2.                        BETA TEST AGREEMENT

  4. _____________, referred to as "the developer" of a computer
  5. program  described as:

  7. _______________, referred to as "the computer software" 
  8.  
  9. and _____________, referred to as the "test-site" desire to
  10. enter into an  agreement whereby _____________ will "beta-test"
  11. the computer software, IT  IS AGREED:

  13. That _____________ will provide full working copies of the
  14. computer  software to test-site for beta-test.

  17. Test-Site acknowledges that the software is the property of and 
  18. is copyrighted by _____________.

  20. _____________ will report any failures of the software to
  21. operate properly  to Developer and will complete in good faith
  22. such questionnaires  as may be sent to the test-site.

  25. _____________ reserves the right to recall the software at any
  26. time, and  to require _____________ to permanently erase with a
  27. file wiping utility  that permanently erases files the software.

  29. _____________ by releasing the software for beta test does not
  30. guarantee  support for the product.

  32. The beta-test period shall begin on ____________ and is scheduled
  33. to end  on _____________.  _____________ may be extended by the 
  34. parties upon agreement.

  38. As compensation for the services supplied by the beta-test site, 
  39. the beta-test site will be provided a copy of the final tested 
  40. and released version of the software with the same support as is 
  41. provided by _____________ to its commercial customers. However,
  42. should  _____________ determine not to release the software to the
  43. general public,  _____________ may continue to use the final
  44. version delivered by _____________,  unless _____________
  45. determines to recall the same as is provided herein.

  50. Test-site acknowledges that the program is not in final or fully 
  51. tested form. Accordingly, failures may occur, and data or other 
  52. results generated by the program may be inaccurate. Given that 
  53. this is a "test" of the software in consideration of the, TEST 
  54. SITE AGREES THAT IT WILL NOT MAKE ANY CLAIM BASED ON FAILURES 
  55. AGAINST DEVELOPER BASED ON THE FAILURE OF THE SOFTWARE TO CONFORM 
  56.
